Vartender, LLC, a Virginia limited liability company (“us”, “we,” or “our”) operates a downloadable mobile app (the “Service”). We are committed to respecting the privacy rights of our customers and other users of the Service. This privacy policy (the “Policy”) describes the privacy practices for using the Service and applies solely to information collected by or through the Service. It does not apply to any information on other websites or apps even if you access another website or software app through this Service. Please read this Policy before submitting any personal information to us.
The Policy informs you of our policies regarding the collection, use, and disclosure of personal information when you register for and use our Service. In particular, it notifies you about the following issues:
- What personally identifiable information we collect from you through the Service, how we use it and with whom we may share it.
- What choices are available to you regarding the use of your information.
- The security procedures in place to protect your information.
- How you can contact us to correct any inaccuracies in the information or for any other reasons.
Information Collection, Use and Sharing
We are the sole owners of the information collected by or through the Service. By using the Service, you agree to the collection and use of information in accordance with this Policy.
Collection and Use
We collect information from you by or through the Service. We ask you to verify your age to determine whether you are old enough to use the Service. You will only be asked to provide this information when you launch the app for the first time.
We also collect information about you when you register, provide feedback or reviews, compile your product inventory, or respond to a survey or communication including an e-mail. When registering, we may ask you for information that may include, but is not limited to, your email address, name, phone number, postal address, and other information. We will use your information for providing and improving the Service, advertising purposes, analytics, identifying and communicating with you, and responding to your requests or inquiries.
When you access the Service, we may collect certain information automatically. Such information includes, but is not limited to, geographic information, the type of mobile device or computer you use, the search terms you may have used, your unique device ID, the IP address of your mobile device, your mobile operating system, the version of the app you are using, the type of mobile Internet browser you use and other statistics. This information is used for analytic purposes.
You may see social media “like” buttons or “share” buttons on our Service. If you use those buttons, we may collect your IP address and where you were on our Service or on social media when you used the button. These kinds of social media features are governed by the privacy policies of the companies providing them.
If you email us or send us other communications directly, we will retain your email or address and correspondence so that we may respond to your request and for compliance purposes. We may retain this information indefinitely so that we have a history of our past communications.
Unless you ask us not to do so through our “opt-in” or “opt-out” procedure (see section below), we may contact you via the app or email in the future to tell you about specials, new products or services, or changes to this Policy. We may also use your information to contact you with newsletters, marketing or promotional materials, and other information that may be of interest to you.
From time-to-time, our Service may request information from you via surveys. Participation in these surveys is completely voluntary and you may choose whether or not to participate and to disclose this information. Information requested may include contact information (such as name and email address) and demographic information (such as zip code, age level, etc.). We will use survey information for purposes of monitoring or improving the use and satisfaction of this Service.
Like many websites and similar services, we use “cookies” in order to make it easier for you to use the Service and for us to gather information about the users of the Service. Cookies are files with a small amount of data and may include an anonymous unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve our Service and your user experience. Please see the paragraph on cookies below to understand your options with regard to such information.
We may use and store information about your location depending on the permissions you have set on your device. We use this information to provide features of our Service and to improve and customize our Service. Please see the paragraph below regarding location information to understand your options with regard to that information.
The length of time that we retain your personal information depends on the purpose for which it was collected. We will not retain personal information for longer than necessary for our business purposes or legal requirements.
Disclosure and Sharing
We will not use, sell, trade or otherwise share or transfer your personally identifiable information with any third party outside of our organization without first providing you with advance notice, except as described in this Policy. We may employ third party companies and individuals to facilitate our Service, to provide the Service on our behalf, to perform Service-related functions, and to assist us in analyzing how users use our Service (“Service Providers”). All personal information shared with Service Providers will be to allow us to better provide the Service in compliance with the California Consumer Privacy Act (“CCPA”). While the CCPA is required for only California residents, we treat all of our users equally and will apply the same protections of the personal information for all of our users.
We contractually require all Service Providers to treat your personal information as confidential information and to only use it for the services we need. However, we do not have direct control over how Service Providers use your personal information and we cannot guarantee that our Service Providers will use your personal information as required in our contract with them. For this reason, we are not responsible for our Service Providers’ misuse of your personal information.

In addition to allowing our Service Providers to have access to your personal information, we may share your personal information in the following situations:
- Business Transfers. As we continue to develop our business, we may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). In the event that all or substantially all of our assets are acquired or we merge with a third-party, your information will likely be one of the transferred assets. You understand and agree that we reserve the right to transfer any information collected from you in the case of any such transfer. In such event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.
- Legal. We will disclose your information where required to do so by law or subpoena, or if we believe such action is necessary to comply with the law and the reasonable requests of law enforcement, or to protect the security or integrity of our Service. We may also release your information when we believe such release is required to enforce our Service policies or protect ours or others’ rights, property, or safety.
Analytics
We and our Service Providers will collect your location and device information so that we can deliver our Service to our users, measure, analyze, and improve the performance of the Service, and continually update and develop our Service.
Advertising
To help us keep our Service running, we show ads in our Service with the help of third-party advertising partners (“Advertising Partners”). We integrate the Advertising Partners’ technologies into our Service, which are then used by the Advertising Partners to determine what kind of ads to display to you.
Advertising Partners collect and use your location and devise information. If location services are enabled in your device settings, the Advertising Partner may additionally collect your geolocation information. The Advertising Partners’ technologies control what kind of personal information is collected from your Device and how it is used.
Your Options Regarding Your Information
Opt-In or Opt-Out: You may opt out of any future contacts from us at any time or change any of your account information by accessing the “My Account” section of the Service or by contacting us at info@vartender.com. Any change will be effective for actions not yet in process. We may also retain any information changed or deleted by you for record-keeping purposes.
Cookies: You have the ability to accept or decline cookies. Most browsers automatically accept cookies, but you can instruct your browser to refuse all cookies or to indicate when a cookie is being used. The Help feature of most browsers provides information on how to accept cookies, disable cookies or to notify you when receiving a new cookie. If you choose to decline cookies, you may not be able to sign in or use other features of the Service, but you will be able to perform basic navigation through the Service.
Clear Gifs (Web Beacons/Web Bugs): We employ or our Advertising Partners may employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our Service by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Service users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Service pages and are about the size of the period at the end of this sentence. We may tie the information gathered by clear gifs to our customers’ personally identifiable information.
We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these emails, please see “Opt-in or Opt-out” above.
Location: You can enable or disable location services when you use our Service at any time, through your mobile device settings.
Advertising: If you do not want to receive targeted advertising on your mobile device, your mobile device may give you the option to opt-out of receiving targeted advertising on all apps on your device. On Android devices, you may opt-out by enabling the “Opt out of Ads Personalization” setting. On iOS Devices, you may opt-out by enabling the “Limit Ad Tracking” setting. Please note that if you opt-out of receiving targeted advertising, you will still receive contextual ads, which are non-targeted ads related to the content of the Service.
Security
The security of your information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, to protect it from unauthorized access, destruction, use, modification, or disclosure. When you submit sensitive information to the Service, your information is protected both online and offline.
If a password is used to protect your account and personal information, it is your responsibility to keep your password confidential.
Wherever we collect sensitive information (such as credit card or bank account data), that information is transmitted to us in a secure way through the use of Secure Socket Layer (SSL) technology and is then encrypted. You can verify this by looking for a closed lock icon at the bottom of your web browser, or looking for “https” at the beginning of the address of the web page.
In addition to using encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees or contractors who need the information to perform a specific job (for example, billing or customer service) can have access to your sensitive information. In addition, the computers and servers on which we store sensitive personal information are kept in a secure environment.
Please understand, however, that no method of transmission over the Internet, or method of electronic storage, is 100% secure. As such, although we strive to protect your personal information, we cannot guarantee its absolute security.
You must promptly notify us if your credit card or bank account, user name, or password is lost, stolen, or used without permission. In such an event, we will remove that credit card or bank account number, user name, or password from your account and update our records accordingly.
Your information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those in your jurisdiction.
If you are located outside United States and choose to provide information to us, please note that we transfer the information, including your personal information, to the United States and process it there. Your consent to this Policy followed by your submission of such information represents your agreement to that transfer.
In the unlikely event that your personal information has been acquired, or is reasonably believed to have been acquired, from us by an unauthorized individual and applicable law requires notification, we will notify the affected users of that breach. We will provide such notice promptly, although notification may be delayed if we or any law enforcement agency determines that notification would hinder an investigation.
Third Party Services: Our Service may contain links to other services that are not operated by us. If you click on a third party link, you will be directed to that third party’s service. We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party services. We strongly encourage you to review the privacy policy of every service you visit, particularly any site that collects personally identifiable information about you.
Children: We provide this Service to people who are of legal age to consume alcohol. As such, we do not knowingly collect personally identifiable information from children under the age of 13. If you are a parent or guardian and you learn that your children have provided us with personal information, please contact us. If we become aware that we have collected personal information from a child under age 13, we will take steps to remove that information from our servers and other systems.
Changes to Your Personal Information
If your personal information changes and you would like to update the personal information in our records, please send an email requesting those changes to the email address indicated below. Alternatively, you can send us your requested changes by mail to the address indicated below.
Changes to Policy
We reserve the right to update or change this Policy at any time and you should check this Policy periodically. Such changes will be effective immediately after being posted on this page. Your continued use of the Service after we post any modifications to the Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Policy. If we make any material changes to this Policy, we will notify you either through the email address you have provided us, or by placing a prominent notice here on this Policy page or our homepage.
